Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Fatal Fear Haunted House, LLC ("Company," "we," "us," or "our") governing your access to and use of the Fatal Fear Haunted House website, online ticketing platform, mobile applications, and physical attractions (collectively, the "Services").

By purchasing a ticket, creating an account, visiting our attractions, or otherwise using the Services, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Services.

Eligibility

You must be at least 18 years old to purchase tickets or create an account. Minors may attend our attractions only with the consent and, where required, the accompaniment of a parent or legal guardian who has read and agreed to these Terms on their behalf.

Certain attractions may have minimum age or height requirements, which will be disclosed at the time of ticket purchase and at the attraction entrance. We reserve the right to refuse entry to any person who does not meet posted requirements.

Tickets, Sales, and Refunds

All ticket sales are subject to availability and the terms presented at checkout, including event date, time, attraction, and any applicable waivers. Ticket prices, service fees, and taxes are disclosed prior to purchase. Tickets are non-transferable except as expressly permitted by our reschedule policy.

Refunds, exchanges, and reschedules are governed by the Refund Policy presented at checkout and are subject to the rules in effect on the purchase date. Except as required by applicable law or expressly stated in the Refund Policy, all sales are final.

We reserve the right to cancel, postpone, or modify event dates and times due to weather, safety concerns, or circumstances beyond our control. In the event of a cancellation, we will offer a rescheduled date or a refund in accordance with the Refund Policy.

Assumption of Risk and Waiver

Our attractions are intense horror experiences intended for mature audiences. They contain strobe lights, fog, loud noises, theatrical violence, actors in close proximity, confined spaces, uneven walking surfaces, and other conditions that may be unsuitable for certain individuals.

By entering the attractions, you voluntarily assume all risks associated with attendance, including the risk of physical or emotional injury, illness, lost or damaged personal property, and any other loss. You should not attend if you are pregnant, have heart or respiratory conditions, epilepsy, claustrophobia, post-traumatic stress, or any other condition that could be aggravated by the experience.

To the fullest extent permitted by law, you release and waive any claims against the Company, its owners, employees, contractors, actors, agents, and affiliates arising out of your attendance at the attractions. Additional on-site waivers may be required and are incorporated into these Terms by reference.

Conduct at Attractions

You agree to comply with all posted rules and the instructions of our staff. The following are strictly prohibited on the premises:

• Touching, striking, pushing, or otherwise contacting actors or other guests;
• Weapons, firearms, or items that could be used as weapons;
• Alcohol or illegal substances; attending while visibly intoxicated;
• Flash photography, video recording, or live streaming without written consent;
• Disruptive, threatening, harassing, or unlawful behavior of any kind.

We reserve the right to remove any person from the premises at our sole discretion without refund for violation of these rules or for conduct we determine endangers the safety or enjoyment of others.

Accounts and Use of the Website

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to provide accurate information and to promptly update it as needed. You may not use the Services for any unlawful purpose or in a manner that interferes with their normal operation, including but not limited to automated scraping, reverse engineering, or circumventing access controls.

We may suspend or terminate accounts that violate these Terms or that we reasonably suspect of fraudulent activity.

Intellectual Property

All content on the Services — including text, graphics, logos, images, audio, video, character designs, set designs, software, and trademarks — is owned by or licensed to Fatal Fear Haunted House, LLC and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any portion of the Services without our prior written permission.

Third-Party Services

The Services integrate with third-party providers including, without limitation, payment processors, analytics providers, email and communications services, and social media platforms. Your use of these third-party services is governed by their respective terms and privacy policies.

Payment services. Credit card, debit card, and ACH (electronic check) payment processing for our ticketing platform is provided by Intuit Payments Inc., a subsidiary of Intuit Inc. Apple Pay and Google Pay wallet transactions, and certain alternative payment methods, are processed by Stripe and Square. When you submit payment information, that information is transmitted directly to the applicable payment processor and is subject to the processor's terms and privacy policy; the Company does not store your full card number.

We are not responsible for the availability, accuracy, content, or practices of third-party services, and your interactions with them are solely between you and the provider.

Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ATTENDANCE AT OUR ATTRACTIONS, WHETHER BASED IN CONTRACT, TORT, STATUTE, OR OTHERWISE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Indemnification

You agree to indemnify, defend, and hold harmless Fatal Fear Haunted House, LLC, its owners, employees, contractors, actors, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Services, your conduct at our attractions, or your violation of any law or the rights of any third party.

Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the Services will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction and venue of those courts.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Material changes will be communicated by reasonable means, which may include email to registered account holders or a notice on the website. Your continued use of the Services after the effective date of any update constitutes acceptance of the revised Terms.
